Does the law require a tank to be tested?
In Delaware the law does not require testing of residential oil tanks, which are defined as above-ground or underground tanks that hold less than 2,000 gallons of oil. If a property has a tank, inspecting or testing the tank is considered part of a home buyer’s “Due Diligence.” A buyer should always have an underground tank tested before purchasing a home.
