Does the Judge Presume Guilt Because of a Past Offense?
Each criminal case must be judged on its own merit. Just because you had a past conviction, that does not mean you are more likely to be guilty this time. The truth is, often people don’t think to hire a lawyer or fight a first DUI charge. They don’t realize at that time what trouble they may be getting in to later just because they pled guilty. It’s also common to see a person who had a rough patch in life some years ago, who had a string of DUIs over the course of a year or two and then nothing on their record for a number of years. But because of those past multiple DUI charges, a small slip up now could cost them their job, their driver’s license, and their freedom if it results in a felony DUI conviction. In some cases, it’s possible to reopen a previous DUI/DWI case to question the evidence and get it dismissed. It may be possible to get charges reduced on this or a past case. We look for every possible option to minimize the risk to our client. Contact an Atlanta DUI defense law
