Yes, the HOA owns the land. Although the State of Texas, Collin County, City of Richardson and Army Corp of Engineers have the right-a-way. Which means if they need to adjust the water shed or protect the flood plain. They have right to come in, work & change that area as they see fit. The maintenance of the creek area is the responsibility of the HOA.
