Does the Federal VGB Safety Act apply to residential pools and spas?
No it does not. When Mr. Baker was drafting the law, he wanted to include residential pools, especially since his granddaughter died in the family spa. He was forced to only include commercial pools and spas, because of the bad economy. Probably in the future they will go after private pools and spas. Commercial pools include: Apartment building, Condominium projects, Hotels, Motels, Health Clubs and, Community Swimming Pools. If you have young kids you might seriously consider at least retrofitting your spa which is where small children are easily at risk. The cost is much less than $1,000.
