Legal fees and costs in probate cases must be approved by the Probate Court before payment. As a result of this rule, no retainer is required before we begin to work on a probate case. However, the family will have to pay the fees and costs when they are approved by the court when the case is completed unless the estate has assets that will result in funds from which legal fees can be paid.
