Answer 3: No, not directly; if it is found that the EA did not follow the regulations regarding a minor change, then CIWMB staff can address whatever issues may result from not following the regulations through the EA evaluation process. For example, if the EA failed to note that a requested change was in conflict with the RFI, the conflict between the change in operations and the RFI may be identified by CIWMB staff. If the EA does not address the conflict through appropriate enforcement actions then the EA could be subject to the process outlined in 14 CCR, Section 18350.
