A continuing request does not have to be accepted by the head of the Calgary Board of Education (the head has the discretion to refuse such as request). Under the Act the applicant may indicate that he or she wishes a request to have continuing effect for a specified time up to two years. If the Calgary Board of Education grants such a request, it is required to establish a schedule showing the dates during the period when the request will be activated. The request is deemed to be received on those particular dates and the Calgary Board of Education has 30 calendar days from that date to make a response to that part of the request. In addition, a different fee structure is set in the FOIP Regulations for continuing requests.
