The levees and canal walls that failed did so because they were insufficiently designed and built by the US Army Corps of Engineers. The then-commander of the USACE stated that on June 1, 2006 in a public speech adressing the start of the first hurricane season after Katrina. However, the federal government (the USACE is a federal agency) has immunity from civil action. That immunity was confirmed by a federal judge this year. The judge stated it was clear the city was flooded due to negligence on the part of the USACE, but the agency was immune from civil action. It always amazes me to read the incredibly uninformed “answers” people post in response to questions about New Orleans. That includes the one from the guy who thinks NOLA is 13 feet below sea level and the one from “Penny Proud” who quotes an “anarchist” source for her information (the source is factually incorrect).
