Does the Act apply to Calgary Board of Education outsourced partners or contracted agencies/individuals?
The focus of the Act is on records in the custody or under the control of the Calgary Board of Education. In addition, under the Act employees of a public body include a person retained under a contract to perform services for the public body. Therefore, documents created by or disclosed to our outsourced partners or contracted parties in the course of doing business with the Calgary Board of Education are likely to be considered records under our control and, therefore, will likely be subject to the Act. It is important to check the agreement we have with the outsourcer or contracted party to see what has been said about control or custody of records.
