It depends on the situation. If somebody is incapable of expressing whether or not they consent (ie in a coma), then silence does not constitute acceptance. Other than that it’s really up to a judge to decide, and it’s pretty much guaranteed that if you’re a reasonable, mentally and physically capable person and silently allowed something to happen without trying to prevent it in any way, and were fully aware of exactly what was happening, that’s acceptance.
