Does publishing pictures of arrestees infringe on the sixth amendment?
Great Gazoo: You do not lose your Constitutional rights when placed under arrest. The most obvious is your Fifth Amendment right which protects you against self-incrimination. Then there’s the First Amendment right which protects your freedom of religion. And most importantly, one is innocent until proven guilty, which is derived from the Sixth Amendment. And regarding a fair and speedy trial, if the attorney feels that his/her client cannot receive such a trial in the current venue due to extensive media coverage, he/she can request a change of venue, which must be reviewed by the judge. If the judge doesn’t at least review the request, a resulting guilty verdict can easily be overturned by an Appellate court due to oppinions written by the US Supreme Court.
