Specifically, Section 103, Subdivision 1 of Article 5-A of General Municipal Law states as follows: All contracts for public work involving an expenditure of more than $35,000 and all purchase contracts involving an expenditure of more than $20,000, shall be awarded by the appropriate officer, board or agency of a political subdivision, BOCES or of any district therein, to the lowest responsible bidder furnishing the required security after advertisement for sealed bids in the manner provided by this section. In addition, the following statutes apply to the bidding process: The Board must advertise in a newspaper which has been designated as the official paper of the BOCES. At least five days shall elapse between the first publication and the date specified for the opening of bids (Art. 5-A of General Municipal Law). The Board may not restrict bids only to residents of the school district or BOCES (Ch. 287, Laws of 1978).
