Does NBI Philippines issues clearance even there is a pending case at the fiscal?
Though the name “clearance” is a misnomer because it just means you requested whatever file the NBI has on you. That doesn’t mean you are “cleared” (as in no record on file) per se. So even if you have been found guilty of murder, you will still get your NBI clearance with that criminal record reported there. You applied and paid for that document. So it will be issued whether or not you have anything on file. BTW, if you have a pending arrest warrant that you do not know about, they will arrest you when you get that clearance. Again, same with the Police Clearance. On the flip side, if you have a name that is the same as one who has a criminal record, this would be a good time to make sure that they know that you are NOT that person who has a record. Only criminal cases with final decisions are forwarded to the NBI for record updates.
