Does General Release at time of job termination, release employers from unpaid wages, compensation?
In state of NY, does “general release” release unpaid wages due to incorrect HR record? I was asked to sign a general release on the day I left my employer. Before I left HR, HR showed me the total payment amount in my termination letter. Later, payment cut short. Payroll could not give a good reason. Calls after calls, I realized HR charged me workers Comp. leaves as vacation leaves and deduct my pay. Despite the employer also received the decision from WC board, I faxed over the copy of WC decision and Payment copy from WC insurance carrier to my Employer. My employer refused to pay the owed wages and its attorney claimed since I had execued the general release, I had released everything. They had no obligation to pay back the two weeks of owed wages. If “general release” also release owed wages and compensation, then Corp. can made errors on HR records and avoid wages payments. And if I don’t sign, I don’t get my final pay.
