Does CMS approve Medicare Set-Aside determinations on liability settlements?
CMS’ policies and guideline change almost daily. As of February 20, 2008 each CMS Regional Office determines whether or not to review liability set aside proposals based upon the specifics of the case and Regional Office workload. If CMS declines to review a proposal all parties should make as accurate determination as possible and completely document their files with their logic. Just make sure all records are documented to show the logic so anyone who might audit at some later date can see the reasoning and that every effort was made to protect the Medicare Trust Fund.
