Does Arizona’s proposed marriage amendment eliminate benefits for same-sex couples?
No. The marriage amendment leaves that decision up to government employers. All the marriage amendment requires is that government employers provide benefits to unmarried employees equally. The amendment has no impact at all on private employers. Have other state supreme courts ruled on the “single subject” rule? Yes. Five state supreme courts (Louisiana, Georgia, Colorado, Florida, and Massachusetts) have addressed this issue. All five agreed that the amendment was accurate as written. How many states have adopted similar marriage amendments? The voters in 13 states have adopted marriage amendments with language similar to the proposed Arizona amendment. Overall, 20 states have passed marriage amendments, with an average of over 70% voting in favor. Marriage amendments have never been voted down by the voters of any state.
