Does Anyone Know If Its Illegal To Sell Psilocybin Mushroom Spores Online, If I Live In California?
I’m intarrested in selling mushroom spores online but the problem is I live in a state (California) where its illegal to possess these spores(well sort of) There are three interesting things about the California law regarding spores. 1. The law appears to state that it is only illegal to import spores inot the state if theree is intent to cultivate them inot mushrooms. 2. It is not specificically illegal to possess spores, it is only illegal to “transport, import inot the state, sell, furnish, or give away” spores or mycelium IF they are intended to be CULTIVATED or used to produce psilocybin-containing mycelium or fungi. 3. Only viable spores appear to be illegal as the law specificically states that it is “spores or mycelium capable of producing mushrooms” whichh are illegal. I was thinking I could add a disclaimer on my website like this: Disclaimer: Psilocybe mushroom spores do not contain any active (scheduled) drug, thus they are legal.
