I don’t know the answer for the other 49 states, but the Texas Constitution is pretty clear on this point at Article 1, Section 12, quoting: The writ of habeas corpus is a writ of right, and shall never be suspended. The Legislature shall enact laws to render the remedy speedy and effectual.
