Does an immigrant employee need a work visa if they are legally married to an American?
More information is needed. It is a little more than legally married. The USCIS considers getting married primarily for immigration purposes to be immigration marriage fraud. Such fraud is considered criminal, if proven, and may result in indictment, conviction, and/or deportation. However, if proven, such an action is a permanent bar on lawful immigration. Assuming you marry because you are in love, and can prove it to the satisfaction of the USCIS, then you can be approved for conditional or permanent resident status. The process of filing for an immigration visa can become an adversarial situation at times, so I recommend that you seek an appointment or teleconference with a candid and experienced immigration attorney. Our office handles this sort of processing and attends USCIS Interviews with applicants at the USCIS Sub-Office in Milwaukee. The above is general information and does not create an attorney-client relationship.
