A No Further Action (NFA) determination is not an attempt to change the name of a toxic condition or findings at a site, as in linguistic detoxification. An NFA is a means of describing the end result of a thorough investigation of a site or area of concern. A No Further Action determination on the part of the NJDEP can be defined as follows: A written determination by the NJDEP that based upon an evaluation of the historical use of the site, or of an area of concern or areas of concern at that site, as applicable, and any other investigation or action the Department deems necessary, there are no discharged contaminants present at the site, at the area of concern or areas of concern, or at any other site to which a discharge originating at the site has migrated, or that any discharged contaminants present at the site or that have migrated from the site have been remediated in accordance with applicable remediation regulations (N.J.A.C. 7:26E -1.8).
