Do Workers’ Compensation (Disability Leave) and Sick Leave Bank benefits count against FMLA entitlement?
Yes. FMLA leave, workers’ compensation, and sick leave bank benefits can run concurrently, provided the reason for the absence is due to a qualifying serious illness or injury. Workers’ compensation leave and sick leave bank benefits will not extend FMLA. Under no circumstances will an eligible employee be entitled to more than 12 weeks of FMLA leave in a 12-month period.
