Do we have legal recourse against the Town of East Lyme if they fail to enter into an agreement with POW?
A. Our recourse would be through the DEP with whom East Lyme has agreed to abate our pollution problem by transferring the 105,000 GPD capacity loaned to them by the State. Should they fail to complete an agreement with us they would be in default of their agreement with the State and subject to recourse by the State.
