The law for the state of TX is that child support for periods prior to the actual court order, can only be ordered up to four years preceding the date of the petition. So if the child is under 4 in your case it is going all the way back to birth. If the child is lets say 10, well then your not going to get 10 years of retroactive support, on 4 years worth. Now, retroactive support is NOT automatic. If he just agees to it then great, your set, but if he argues, they may or may not order it. It all depends on the rest of the circumstances. His name was not on the birth certificate, but that alone will not be enough to get him out of any retro support. He will have to prove that he really did have no knowledge of the child, or if the child is older, he hasn’t had an actual relationship with the child at all.
