Do the Buy American requirements of Section 1605 of the Recovery Act apply to a project that benefits from a loan guarantee under Section 1705?
Applicants must consult their own legal counsel to determine whether the Buy American requirements of Section 1605(a) of the Recovery Act apply to their proposed projects. If an Applicant believes that its proposed project is not subject to such Buy American requirements, it must set forth in its Part I submission an explanation justifying such rationale. If an Applicant determines that its project would be subject to the Buy American requirements, but that its project may be eligible for a waiver under Section 1605(b) of the Recovery Act, such Applicant must set forth in its Part I submission an explanation justifying the basis for its request for a waiver.
