Do patients have a right to experimental drugs?
The author reflects on the issue concerning patient with life-threatening disease right to experimental drugs. She cited that the U.S. Court of Appeals for the district of Columbia held that terminally ill patient do not have the constitutional right to get experimental drugs unless enrolled in a clinical trial. However, she contends that these patients can get unapproved drugs through the FDA’s Compassionate Use program and Expanded Access program.
