DO MOTHERS AUTOMATICALLY GET CUSTODY OF THE CHILDREN IN A DIVORCE CASE?
By law, the Court must look to certain factors under the Child Custody Act to determine what is in the “best interest of the minor children” before ruling on which of the parties should have custody. Increasingly, the Courts will automatically grant joint legal custody and consider strongly joint physical custody of the minor children. It is all based on what is in the best interest of the children and is not automatically granted to the mother of the children.
