Under the Migration Regulations a person can only be a ‘spouse’ if he or she is married or in a ‘de facto relationship’ with a person of the opposite-sex.[2] The Migration Act 1958 (Cth) does not recognise a marriage between same-sex partners which took place outside Australia.[3] Thus, a same-sex partner can never be a ‘spouse’.
