Do lemon laws apply to new and used cars in North Carolina?
The North Carolina Lemon Law doesn’t cover used cars; it only covers new cars. In addition to passenger vehicles, falling under this legal umbrella are motorcycles, pick-up trucks, and certain vans. Under this law, which also goes by the name of the New Motor Vehicles Warranties Act, a vehicle manufacturer must repair any defects that jeopardize the vehicle’s value, use and/or safety within the first 24 months or 24,000 miles (whichever comes first). In NC, your vehicle becomes a lemon if: • The problem is covered under the manufacturer’s warranty. • You notify the manufacturer of the defect in writing and give the manufacturer no more than 15 days to have an auto repair mechanic correct the problem. • There have been four or more attempts to fix the problem but it still exists.
