You do not need a lawyer but it certainly helps depending on what state you live in I would start out by going to the states website. Mine is Indiana so I go to www.in.gov and you should be able to get a lot more information there. I would suggest a lawyer though. I did the same thing with my daughters father and he treated me like he was doing me a favor by giving me fifty bucks when he “had” it – I did this for 9 years and finally just had enough. I paid my lawyer 1200.00 and he tried to negotiate without going to court (without success) so we went to court and it was over. Now every week his child support is taken out of his paycheck and I don’t ever have to call and ask for it (worth every penny of 1200.00!! lol) Good luck!

No, you do not need your own lawyer. Go straight to your local cs office and request a new order. It does not matter that your previous agreement was verbal, or that he has or hasn’t been following it. You can request an actual court order at anytime up until the child is 19-21 depending on your state. The cs office has their own lawyers on payroll, and they will take care of everything for you. All you’ll need to do is give them any info. they ask for and show up. It may also be possible that he should have been paying you more in the past, in which case you may get some back support as well. Once you have the court order in place you won’t have to fight with him over it any more, they’ll take it straight from his checks, he won’t have a choice. Also, they will more than likely order him to get med insurance for the child as well, which will help with your med bills.
