Traditionally, courts have never recognized a constitutional right for grandparents to raise their grandchildren or be involved in their grandchildren’s lives. However, there is a new law in Florida that states if a parent is activated, deployed, or temporarily assigned to military service on orders in excess of 90 days, the parent may designate a family member, a stepparent, or a relative of the child by marriage to engage in time-sharing on the parent’s behalf. This type of designation may in fact create a legal right on behalf of a grandparent.
