A UK AR has its own passporting rights under the IMD and does not have to rely on the passport rights of its principal. A UK AR carrying on insurance mediation activity can passport into other EEA states if it’s principal permits it to do so. A joint passporting notification should be submitted to FSA on the AR’s behalf (we e require the principal to notify us as well as the AR to ensure that the principal is aware of the AR’s activities and accepts responsibility for them). The usual rules apply, so that the AR can only carry on regulated activities for which its principal has permission and which it is permitted to carry on by the AR Regulations (for example, dealing as agent can only be carried out by an AR dealing with general and pure protection insurance). The AR’s principal will also be responsible for ensuring that the AR complies with the relevant conduct of business rules.
