Yes. Unlike other single market directives, the IMD gives Appointed Representatives (ARs) passporting rights. So a UK AR can carry on insurance mediation activities in other EEA states by exercising rights under the IMD. The AR should discuss its wish to passport with its principal. If the principal agrees, the principal should submit a passporting notification to us on the AR’s behalf. (We require the principal to notify us to ensure that they are aware of the AR’s intention and accept responsibility for the AR’s passported activities.) The usual rules apply − the AR can only carry on those regulated activities its principal has permission for and that it is permitted to carry on by the AR Regulations. For example, an AR can only carry out dealing as an agent if it deals with general and pure protection insurance.
