Do all projects under contract with a public body require the posting of a performance bond?
No. Under Minnesota law there are eight exceptions to the general rule that performance bonds are required on public jobs. These eight exceptions generally give the contractor the option of posting security, such as a bid deposit or a cashiers check, rather than a performance bond. These exceptions apply only to specified small dollar amount contracts or natural resources development projects.
