Do all Motions for Summary Judgement result in a court hearing?
A motion for summary judgment does not require a hearing if, on the face of the pleadings before the court, there are no issues of material fact and one party is entitled to judgment as a matter of law. That means the judge looked at whatever you provided and decided that even if everything you presented was true, there were no facts that would entitle you to judgment in your favor. In order to win the motion, you would have to show a dispute of material facts exists (not the strength of those arguments – just that a dispute of material facts exists).
