Didn “Truth In Sentencing” Abolish Parole?
Pursuant to the Truth-In-Sentencing Act of 1989, parole was abolished for all offenses committed in Delaware on June 30, 1990, or thereafter. However, in all criminal cases sentenced in Delaware following the enactment of the Truth-In-Sentencing statute, when the Court imposes an aggregate sentence to Level V (incarceration) in excess of one (1) year, the Board, upon receipt of an application for sentence modification (also called “4217 sentence modifications”) from the Department of Correction, holds a hearing for the purpose of providing the sentencing judge with a recommendation.
