Didn the California Supreme Court rule against same-sex marriage?
No. The California Supreme Court has never ruled against same-sex marriage. The vote on Prop 8 resulted in the Marriage Amendment to the California state constitution. When the California Supreme Court ruled on Prop 8, they narrowly tailored their ruling to focus on how the California state constitution was amended; NOT on the constitutionality of the Marriage Amendment, itself. In fact, in the written opinions of the justices they admit that the new Marriage Amendment violates the Equal Protection Clause of the California constitution. This is the basis for the Marriage Equality Defense Fund’s lawsuit happening now. If you believe in equal protection for all marriages, then show your support by donating to our legal fund.
