When the California Supreme Court ruled on Prop 8, they narrowly tailored their ruling to focus on how the California state constitution was amended; NOT on the constitutionality of the Marriage Amendment, itself. In fact, in the written opinions of the justices they admit that the new Marriage Amendment violates the Equal Protection Clause of the California constitution.
