Did the Province or the Ministry of the Environment ever fine or otherwise sanction Westinghouse for allowing the PCBs to contaminate Pottersburg Creek?
In 1984, when the company was confirmed as a major source of PCBs in the Creek, the ministry issued an order which required Westinghouse to clean up their property to prevent further discharge of PCBs.In 1985, follow up sampling showed that additional work needed to be done to prevent PCBs from moving off of the Westinghouse property. The ministry issued a second order which required the company to collect its storm water, treat it to remove PCBs, and then discharge to the sanitary sewer. In 1985, the Ministry of the Environment, City of London, and Westinghouse Canada Inc. signed an agreement which required Westinghouse to contribute funds towards the cleanup. In this agreement, the ministry agreed that it would not pursue Westinghouse for the PCB discharges that occurred before the date that the agreement was signed.
