Did the cop have probable cause to search my car?
A Police Officer has the right to search your car for any reason, as long as it’s justified. If a PO sees you make a jesture as your trying to conceal something, as in your case throwing your jacket, an officer has the right to take a look. If for example, the officer sees you bending down, like your reaching under the seat then the PO has the right to look there. If the officer smells marijuana, fresh or burned, the officer now has the right to search for the source. If an officer sees what appears to be the handle of a handgun, he has the right to go into your car even if it turns out to be a hair brush. If the PO sees something suspicious on the driver floorboard and it turns out to be nothing, the PO cannot justify finding a bag of weed in the glove compartment. If an officer pulls you over and sees a small bag of weed on the floorboard, he/she now has the right to search you car for more contraband and whatever else turns up, you are now guilty of as well.
