Death in the family, need help!?

Well in most states (if not all), the wife, regardless of what the will says, gets a share of the estate. Because your friend never got a divorce, the wife will be entitled, by law, to some of the estate but not necessarily the house, although homes that are subject to homestead laws have special rules in some states. Your friend really needs to consult with an attorney who specializes in wills and estates, FAST (not family law). If I were your friend, I would not give the wife any of the paperwork but instead get an attorney and advise the wife to contact that attorney. P.S. While Mark kindly informed you about the laws of intestacy in Pennsylvania, the laws of intestacy are not relevant because your friend had a valid will. Intestacy laws apply when there is no will.

You need to get an estate lawyer to take over your friend’s estate. That’ll prevent the wife from doing something altogether. The longer you wait, the more likely the wife will do something.

After 7 years, he should have legally divorced his wife. One would think that it would have been at the forefront of his priorities to get it out of the way so that his longtime girlfriend wouldn’t have to spend lots of money to get what she deserves.

The wife probably gets the house I would have her talk to the lawyer but legally she might have to move out.

if her name is not on the deed…the will will need to be probated at which time the wife can contest it…and may well win.
