If the court order is from a relevant jurisdiction and it ordered expunction of the arrest and the local police didn’t remove the record, you have a cause of action. So, go for it! You might want to consider sending a copy of the order to the police department and asking for a meeting with the Chief so you can discuss expunction. There is a good chance the record will be expunged rather than them having to mess with you. A lawsuit is usually very expensive and you never know for a fact how it is going to result. Yur cause of action though seems to be good, based on the facts you presented, and you might get a mandamus to expunge. Try the cheap way first, though.
