You can drink some alcohol and drive without getting a dwi. But, one night I was on my second beer which I thankfully decided not to drink and while driving home there was a destructive blind man in the middle of a dark street. I slammed on the horn and barely avoided him. I think if I had killed him, the police would have given me a breath test and his family could have sued me civilly claiming that I had some alcohol in me. In my state, I can be found 10% liable so if the award would be 10 million, I’d be liable for 1 million plus my court costs. It turned out that the blind man was an alcoholic diabetic who required an ambulance on a weekly basis. The police were surprised he wasn’t dead already and he has since died. I was very angry with him as I could have been killed by the driver behind me. I don’t drink and drive because DWI isn’t the only concern. Being sued civilly is also a concern.
