Unfortunately, your employer has the right to terminate you if you take more than 12 weeks FMLA leave. FMLA only saves your job for you for 12 weeks max. Anything more than that is up to the company and your supervisor. If they want to save the job for you, then can, but if they need to have someone in that position, they are well within their rights to terminate you if you do not come back after 12 weeks. I’m sorry you are going through this, but the U.S. does not have good maternity/prenatal leave laws.

No, they can not fire you. The 12 weeks is the benchmark to return to your your exact position. After 12 weeks and up to a year they have to let you return, they can change your shift, position (as long as it is comparable) and they can not demote you!
