Can Wisconsin state courts refer cases to the Tribe?

0

Yes. Under Wis. Stat. 801.54, if the Tribe has concurrent jurisdiction (meaning the case could be heard in either court because both courts have laws that would apply and have jurisdiction over the parties) then the State court can transfer the case over to Tribal court. The Tribe can also transfer cases over to State court if the case is more appropriately heard there.
