Can we release a piece of OER course material which also contains fully referenced quotes? Are we in breach of any IPR regulations if we release such material?
Fair dealing under The Copyright Designs and Patents Act (CDPA) 1988 is unlikely to succeed as a defence when copying quotes and uploading them to the open internet as an O.E.R. Even where materials are used for purposes of non-commercial research, private study, criticism and review, and for educational purposes, making quotes/extracts freely available on the internet may be considered making multiple copies of the material and could still be considered a breach of copyright.
