The following conditions apply: 1) they must be a bona fide and full time regular employee of a U.S. institute of higher learning;2) they must reside here the whole time they have this employment status;3) they cannot be citizens of nations proscribed in ITAR 126.1. Their employers must inform them in writing about their obligation not to transfer this technical data to other foreign persons. Similar restrictions apply to access to technical data and hardware subject to Commerce Department regulations.
