Can the YOT add a requirement during the course of an order?
No, the order is imposed based on offence seriousness and the young person’s circumstances at the time of the offence (e.g. specific offending behaviour patterns). Adding a requirement during an order that was not appropriate at the time of the original sentencing would be disproportionate and inappropriate. If the young person requires support to reduce their likelihood of offending then this should be dealt with by the YOT as part of their intervention plan. However, the YOT can take a case back to court to amend the order where appropriate. At this point requirement(s) could be removed and substituted with others. However this will largely be due to the fact that the requirement becomes unworkable, unavailable etc. as opposed to addressing a new risk in the young person’s life.
