Can the user choose to exclude files & folders while using the virtual protection in RSS/RVS?

No and yes, it depends on the version of the software you are using and its approach to supporting the saving of content to your real disk. In RSS Pro 2011, RVS Pro 2011, and paid versions of RVS 2010, commit to disk operations are handled through the File Manager feature. In RSS Pro and RVS Pro 2011, the File Manager includes a new Autosave option where the content you define can be saved to the real disk in the background on a schedule (every minute to every 24 hours) and/or at account log-off/computer shutdown. For those still using the older RVS 2010 series, the older generation File Manager does not have atuosave capabilities so content within your list must be saved manually by forcing the issue using the “Update selected” link in the FM or tray icon/toolbar. In the RVS Lite 2011 series, virtual exclusions are available.
