Can the UAs newspaper post a persons photograph on the Internet without their permission?
Under the First Amendment to the U.S. Constitution, the University cannot exercise editorial control over the Arizona Daily Wildcat because it is a news organization with First Amendment protections. Moreover, a news organization can print an individual’s photograph without permission if the photo was taken in connection with a “newsworthy” event. Whether a person’s photo was taken in connection with a newsworthy event is something that would have to be taken up directly with the Wildcat, not the University.
