Can the state seize my joint checking account & overdraft my account for the other parties back child support?
It doesn’t matter who’s primary and who’s secondary, the account is joint and both people have equal rights to it. The secondary person can withdraw all the money, close the account, anything you can do, they can do, in the eyes of the law the account is his as much as it is yours and the state can seize it. Unfortunately this also means that any overdraft fees that you incurred because you didn’t know the state took the money out of your account are also your responsibility. And may I say: Ouch, you’ve added the wrong person to your account. Why would you want to be with a person who doesn’t even take responsibility for his child/children? He must have not been paying the child support for many months if the state took that much money out of your account. I guess we live and we learn: kick the guy to the curb and be more careful next time, or at least do not mingle your finances with anybody else’s. Good luck to you!
