Can the Receiver provide me with an accounting of the frozen assets of Defendant La Madrid (“La Madrid”) or Relief Defendants Palladium Holding Company (“Palladium”) and Donald Lopez (“Lopez”)?
No. Neither La Madrid, Palladium, nor Lopez were placed into receivership, and the Receiver has no present control over them or their assets. Pursuant to the Court’s PRELIMINARY INJUNCTION AND ORDER: (1) FREEZING ASSETS; (2) APPOINTING A PERMANENT RECEIVER; (3) REQUIRING ACCOUNTINGS; AND (4) PROHIBITING THE DESTRUCTION OF DOCUMENTS, the Receiver was appointed as permanent receiver only for the fund entities in receivership. At this time, the Receiver has no authority or control over any other person or entity in this matter. The Receiver’s investigation and recovery efforts continue, but the Receiver cannot provide an accounting of the assets of La Madrid, Palladium, or Lopez at this time.
